Mayor pleads guilty to drink-driving: fined, banned

MOUNT Isa Mayor John Molony refused to comment on whether he would resign after he was handed a $2000 fine and disqualified from driving for four months in the Mount Isa Magistrates Court today.

Waiting media outside the court asked Councillor Molony if he would resign or contest the next local government election in March.

He declined to comment.

The court heard today that on December 31, 2011, Councillor Molony had consumed a half-bottle of red wine with fried rice for dinner, then drove to the Mount Isa lookout with his wife Heather.

They then went to the Overlander Hotel where he admitted consuming another half bottle of wine and three Pure Blonde beers before driving home.

Police at a static random breath-testing site in Marian Street stopped Councillor Molony about 9.45pm.

Police noted the defendant “smelt of liquor, had bloodshot eyes and his face was flushed”.

The court was told Councillor Molony returned a blood-alcohol reading of 0.111g.

Representing Councillor Molony was solicitor Mr Anderson Telford who requested Magistrate Rod Madsen to record a “no conviction’ because of the 69-year-old Mayor’s previous good driving history and the lack of any criminal conviction.

He said Councillor Molony had “suffered political and personal embarrassment because of the media” since his arrest, and requested the Magistrate take into account the Mayor’s “general good character; a man of good standing, leadership and integrity”.

Magistrate Madsen agreed saying “too much had been said by too many people”.

“But you will be sentenced for what you have done, not who you are.”

He said Cr Molony “does not get preferential treatment because you are the Mayor”.

Magistrate Madsen said he “had a strong view on drink-driving offences”.

Councillor Molony pleaded guilty, and no conviction was recorded.

Fair call by Mr Madsen I thought. However I would like to point out that Monsignor Maloonys face always looks "flushed".

So the mayor can get charged with HIGH range drink driving and get off with only a 4 month suspension and no conviction. Rod Madson has set a precedent in court that means everyone who gets a more severe penalty for the same or lesser offence can challenge it. If a judges wife is a plaintiffs doctor should that be recorded as a conflict of interest ?

Its over.

And another thing.. what if anything, has the plaintiff's doctor got to do with it. Surely a Magistrate would not hear a case if he or she had any inkling of a conflict of interest.

I feel outraged at outraged, what a dill. Are you a non-drinker, non-social, non everything who judges others for what you have done yourself? Go back to your Labour back-benchers and come up with something worthwhile to bitch about. Or could that be a conflict of interest!!!

i'm not one to condone drink driving, but why should the mayor have to put up with public humiliation but no other drink driving person does!

If it is good enough to name and shame our mayor. NAME AND SHAME EVERYONE!

Ya got it wrong again NWS it was mid range 0.11 per cent .. Please get it right so you don't wind up the hollier then thou God fearing angels trying to down grade our mayor !

It really just proves he's normal . What would of happened if the coppers let him go because he is the mayor . The cranks would have had a litter of pups before it go to the papers ..

So "outraged" is upset.

Seems outrage is a consistent condition, particularly amongst those whom also use the nym "anon".

Be as outraged as you like but bear in mind, Contempt has a very broad interpretation in law and a nym will not protect you from prosecution.

Think long about it friend. See you in the dock.

This is a complete joke. Molony said previously that he had only had a couple of drinks when questioned. now we find out her had half a bottle of wine, then went driving, had another bottle of wine and a few beers, and then went driving again. For Madsen to say that he sentences on what you have done not who you are is pathetic and a downright untruth... it is clear here that 'who he is' managed to influence the penalty. Christ, I hope he stands again, just to get his a**e handed to him.

And yet the council is silent on weather he was driving a council supplied vehicle.

If our rates provided the car he was drink driving in, then he should resign because he has abused the office he was elected to represent.
