Judge Carmody will take up the mantle just hours after Paul de Jersey's term finishes at midnight on July 7.
Attorney-General Jarrod Bleijie could not give any further details on who would swear Judge Carmody in.
Traditionally it is a role which falls to the state's second most senior judicial officer, which in this case is Court of Appeal president Margaret McMurdo.
But the appointment of Judge Carmody to the position has divided the judiciary, with many, including former Solicitor-General Walter Sofronoff, publicly questioning his links to the government and his experience.
Mr Bleijie said the details of Judge Carmody's swearing-in ceremony were "still being finalised".
"That's a matter really for the courts," he said.
"I know the department of justice, the courts and Mr Carmody are in consultation about that process at the moment."
