Dan Shearin was jailed on October 27 for harassment, after he sent 1439 text messages to Breeana Robinson in the weeks leading up to her death in January 2013.

Ten minutes before Ms Robinson, 21, plunged from Shearin's Gold Coast apartment balcony she received a text which read: "You're more interested in TV, food and everything else but your partner. That's why everything's ruined. Your priorities are f***ed up".

In other messages he called her a "complete f***ing moron" and a "stupid bitch".

Shearin, a 41-year-old former cruise ship entertainer, will apply for bail in the Southport District Court on Monday and argue the minimum two-month prison sentence imposed was "manifestly excessive".

Shearin once penned a book about his "incredible life" at sea, with an online author biography proclaiming there was "no more well rounded entertainer hailing from Australia these days".

According to court documents lodged by Shearin's lawyers, his employer Wyndham Resorts sent him a letter saying the harassment conviction was in breach of his contract and "compromises the integrity of the business".

In response, Shearin wrote that he had "reasonable prospects" of getting bail and could continue working for the company as a full time travel agent if released.

"I would ask you to consider my previous good service and allow me an opportunity to respond and to put forth reasons why I should be allowed to continue with my employment in the event I am granted bail," he said.

Shearin also said if he remained in custody he would not be able to pay rent for his Nerang house, leading to action being taken against him by his landlord.

If bailed, Shearin will surrender his passport and report to the local police station.

Police prosecutors had not lodged their documents by Friday afternoon, meaning it is likely their brief will be handed up in court on Monday.

While Shearin has already pleaded guilty to harassing Ms Robinson, his solicitors Hannay Lawyers argue he should be bailed to appeal the severity of the punishment.

They said it was "not feasible" for the appeal to occur before the final available court date this year, December 1. Given court would not resume until January 19 next year, Shearin would spend nearly two months in custody if bail was rejected.

His lawyers will use a 2008 case for the basis of the appeal. On that occasion, Queensland man Daryl Hooper was only fined $500 for sending a threatening text message to his housemate.

The state Attorney-General appealed the sentence and argued it was too weak, however the Court of Appeal upheld the original sentence.
