With Queensland MPs becoming constitutional experts since the January 31 election, scrutiny has turned to Labor leader Annastacia Palaszczuk's visit to the Governor on Tuesday and whether it was "appropriate".

Labor, as they have with almost every issue which had arisen since the election, stayed silent on whether or not Ms Palaszczuk received an invitation from His Excellency Paul de Jersey. She announced the visit on Twitter.

A spokesman later supplied a statement.

"Because of the unusual circumstances of the prolonged caretaker period, the Governor's office advised the Opposition Leader's office that the Governor thought it would be courteous and appropriate to offer the Opposition Leader the opportunity to update him on relevant issues," he said.

Campbell Newman had visited Governor de Jersey earlier in the day to tender his resignation as premier, but will remain as caretaker leader until a new government is formed.

The LNP's Scott Emerson told Fairfax Radio 4BC it was important politicians were not seen to be pressuring the Governor.

"I think the important thing here is there are very clear rules on this, conventions in place under the Westminster system," he said.

"And the important thing here is that politicians are not pressuring the Governor to make a decision.

"[LNP Leader] Lawrence [Springborg] would go up if he was invited.

"The important thing here, we have the Governor who is one of the most learned legal minds in Australia, a former Chief Justice, he has to make his decisions based on convention and rules and it is important that no politicians, certainly not the leaders of the parties, are there being seen to be pressuring the Governor over the decision.

"He has to take legal advice and do the right thing."

Labor's Jackie Trad said there was nothing unusual about Ms Palaszczuk's visit, although she could not say how it came about.

"It is normal and right that during a caretaker period that both the caretaker Premier and the Opposition Leader have an open relationship with the Governor," she told Fairfax Radio 4BC.

"That is normal, and in these unique circumstances you would expect the Governor would be talking to both the Caretaker Premier and the Opposition Leader."

But while the LNP are falling back on Westminster traditions in their argument to stay on as caretaker government, Labor has turned to the courts.

The result in Ferny Grove will be referred to the Court of Disputed Returns by the Electoral Commission of Queensland as soon as it is declared, given the Palmer United candidate should not have been included on the ballot.

The LNP hopes the court will rule the result - which is expected to fall Labor's way - invalid, sparking another election in the seat.

If that happens and Labor loses, the parties would be tied on 43 seats each. With the support of the two Katter Party MPs, the LNP could form government.

Sunshine Coast independent Peter Wellington has already pledged his conditional support to a Labor government led by Ms Palaszczuk.

Ms Trad said the LNP should not get its hopes up.

"There are precedents where ineligible candidates have stood for election and there have been outcomes where re-elections or by-elections have not been issued out of a court hearing and where they have," she said.

"So it will ultimately be up for the parties to determine through argument and the presiding judicial officer to determine the matter."

But Ferny Grove is not the only seat in doubt.

The Queensland Times has reported a full recount of votes has begun in Lockyer where Pauline Hanson finished 184 votes behind* of the LNP's Ian Rickuss on the notional count.

Mr Rickuss had won the majority of primary votes, but an unexpected preference flow put Ms Hanson within sight of taking the seat.

The ECQ does not expect a result in Lockyer until the end of the week.
