Ms Palaszczuk ordered the state executive to expel Cook MP Billy Gordon from the party on Sunday after discovering he had been "dishonest" with her.

She also advised Mr Gordon to resign from parliament, which would leave Labor in danger of falling one seat short of a parliamentary majority - Labor won 44 seats, including Cook, while the LNP claimed victory in 42. Independent MP Peter Wellington committed his support to Labor, giving Ms Palaszczuk the majority in the 89-seat parliament she needed to lead.

But if the LNP win any potential by-election and secure the support of the two Katter MPs, the balance of power could tip back to the previous government.

Late Sunday, Mr Gordon issued a response: "I am presently weighing up my options after the advice I have received from the Premier that she has asked for my expulsion from the Labor Party," he said.

"I am very concerned that I should be afforded natural justice in any determination that my tenure as the Member for Cook should be terminated because of her move to see me expelled from the Labor Party and her wish for me to resign as a Member of Parliament.

"The Premier has previously requested that the Police Commissioner investigate whether I have transgressed any law and that process should be allowed to continue its natural course. Any other attempt to remove me from the Parliament and force me to resign is a denial of natural justice.

"I have a serious eye operation tomorrow and I need further time to consider my options, seek further legal advice and have ongoing discussion with my family and my supporters. I will therefore make no further media comment at this time.

"I am very concerned at the impact this situation is having on my children who I love very much."

Offences

Ms Palaszczuk said she was left with no choice after Mr Gordon's past criminal record, which included property offences in the 1980s, breach of probation and bail conditions, as well as driving offences in the 1990s and being served with an Apprehended Violence Order in 2008, came to light.

It is understood a police check carried out against Mr Gordon, standard procedure during the pre-selection process, came back clear. Under the Rehabilitated Offenders Act, last made prominent in Queensland politics following former LNP MP David Gibson's past being revealed, offenders who spend no or less than three years in prison, who do not re-offend, effectively have their record cleared after 10 years.

It is an offence to reveal details of criminal histories protected under the act, unless the person chooses to disclose them.

Mr Gordon said the AVO was not heard in court, nor formed part of his criminal record, in a statement detailing his past.

Failure to declare

He had told the party only about a 1987 juvenile offence and two driving disqualifications during his pre-selection process.

Mr Gordon also signed a form disclosing he had nothing else to declare to the party twice during his 2013 federal run and during his candidacy for Cook.

Lied to Premier

On Sunday, Ms Palaszczuk said Mr Gordon had lied to her when she confronted him over allegations his former partner had made against him in a letter she sent to various MPs, including some in Opposition, asking for help in making Mr Gordon meet his child support responsibilities.

The letter also alleged Mr Gordon had deliberately avoided filing tax returns so his income would remain undeclared.

Mr Gordon admitted to both in a personal explanation to parliament on Friday. Ms Palaszczuk, who had dispatched State Labor Secretary Evan Moorhead to speak to the woman and Mr Gordon to help rectify the child support situation, said in parliament on Friday she believed the matter was finalised.

The letter also contained allegations of domestic abuse, which Ms Palaszczuk only referred to police on Friday evening, after a website linked to former north Queensland LNP MP Gavin King made them public.

Mr Gordon is understood to have told the party any abuse directed at the mother of his two children was verbal and not physical.

The letter is understood to allege otherwise.

While the police investigation into the domestic violence allegations is on-going, Ms Palaszczuk said Mr Gordon's position became untenable when she discovered he had also lied to her, and the party.

"The Deputy Premier and I sat down with him on Tuesday night and we made it clear. He sat opposite me and I said is there anything else I need to know. Is there anything else I need to know. He looked us both in the eye and said no, there is not. No, there is not. He was dishonest with me. He was dishonest with the deputy premier."

Opposition

The Opposition believes Ms Palaszczuk failed her own credibility test by failing to disclose or act on the domestic violence allegations until after they were reported in the media.

Opposition Leader Lawrence Springborg said Mr Gordon's past was one only part of the issue, with Ms Palaszczuk still to explain why she waited to act on the domestic violence allegations.

Ms Palaszczuk said she became aware of issues relating to Mr Gordon's past on late Friday afternoon.

Reviewing selection process 

Within Labor, attention is now turning to how the party ended up in this position.

Before winning Cook with a 10.2 per cent swing against the LNP, Mr Gordon had stood for federal parliament in the 2013 election and worked for Labor Senator Jan McLucas.

"Good question," a visibly angry Ms Palaszczuk said when asked how Mr Gordon's past slipped through the party's vetting process.

"And I want to know too. The party needs to have a thorough review of their selection process. He was a former federal candidate, he was a candidate for us and he was elected. To say I am disappointed today would be an understatement.  '

"I feel absolutely sick, disgusted...for this to happen is unbelievable."

Ms Palaszczuk said she was unaware of any other issues with her MPs.

Mr Moorhead said the party would review its pre-selection processes.

But he said the party had made the checks it was legally able to, with anything else for the candidate to reveal.

"As requested by the Premier, the ALP State Administrative Committee will meet tomorrow to expel Billy Gordon from the ALP. The ALP requires all candidates for public office to complete a National Police Check through the Australian Federal Police," said Mr Moorhead.

"Neither of the two police check certificates the ALP has received for Mr Gordon disclosed any offences. I understand that this is due to the length of time that has passed since the offences were committed. The ALP is currently reviewing its vetting procedures to identify improvements that can be made."

Moving forward

Mr Gordon was receiving emotional support from the party and declined to comment.

He had told party bosses he would consider his situation and would make a decision on whether he would remain in parliament, "soon", but no time line was provided.

Without Labor's endorsement, Mr Gordon must sit on the cross benches as an independent. The Parliament can act to expel him, a move last considered in regards to Scott Driscoll in 2013, but which has not been used in modern history.

Ms Palaszczuk said she would not "deal in hypotheticals" and would continue to govern as usual.
