Brumbies chief executive Michael Jones will return to court on Thursday morning where it is expected he will learn if he will lose the whistleblower protections safeguarding his job.

The Brumbies board will then be forced to front an extraordinary general meeting on Thursday night regardless of the outcome of the court proceedings as Canberra club rugby presidents seek answers as to why Jones was stood down and the KPMG report that is part of a suppression order in the ACT Supreme Court.

Justice Richard Refshauge is expected to rule on an injunction placed on the board's decision to stand down Mr Jones last month following an interview on ABC Grandstand.

Mr Barr was part of discussions with Brumbies chairman Robert Kennedy and ARU chief executive Bill Pulver when the club's board decided to stand down Mr Jones.

Mr Barr said: "The sooner it's resolved, the better for the Brumbies fans, the Brumbies administration. Really for the team itself as well. Whilst you can separate on and off the field, it's obviously a lot easier for the players if the off-field issues are resolved.

"Our concern relates to the Brumbies brand and important strategic partnerships. We were hoping to work with the Brumbies to use the brand positively in New Zealand as part of the international flights opening up to Wellington.

"... In the longer term, we're keen to ensure that we can have that cooperative and constructive relationship with the Brumbies. Their off-field matters are for them.

"But undoubtedly there are bigger implications in terms of not just the government, but sponsors and supporters. Hopefully it is resolved and everyone can move on."

Brumbies stakeholders and boardroom voting members were notified on Wednesday that the EGM would be held on Thursday night despite some Canberra clubs withdrawing their support.

The KPMG report into transactions at the Brumbies between 2009 and 2013 has been the source of angst between Mr Jones and several stakeholders.

The report is part of Mr Jones' evidence in the ACT Supreme Court and is not available publicly. It relates to the $11.375 million sale of the Brumbies' Griffith headquarters and subsequent move to the University of Canberra.

Mr Jones claims to have made disclosures in the public interest about the sale of the Brumbies headquarters and subsequent relocation to the University of Canberra.

Several Canberra clubs have seen the report, while it is believed it will be offered to Brumbies voting members to view before the EGM if they sign an undertaking not to take a copy of the report out of the room.

The two agenda items at the EGM are to dissolve the board and elect a new one, but it remains unclear whether there will be enough voting support to pass the motions.

Canberra clubs hold the balance of power in the Brumbies boardroom, with 14 of a possible 23 votes.

Mr Jones was granted temporary protection and allowed to return to work last month, while the board was gagged and restricted from discussing or taking action on his employment.

But the Brumbies hit straight back, launching action to overturn Mr Jones' temporary protections, arguing, among other things, his disclosures were not serious enough to warrant whistleblower protection.

Justice Refshauge refused to reopen the case last week and said he would give his reasons on Thursday.

The judge also indicated he would decide on Thursday whether or not to continue the injunction at present protecting Mr Jones.
