Solicitor Warren Hunter appealed for client Jaime Sam, 17, in the Mount Isa District Court last Friday because he considered 18 months probation and 40 hours community service to be “manifestly excessive”.
Sam was charged with obstructing police and pleaded guilty. Yet the magistrate’s court prosecutor told Magistrate Stephen Guttridge the circumstances seemed like assault.
Mr Hunter said in his district court appeal that the prosecutor’s comments may therefore have influenced the magistrate to consider the crime an assault.
Nine to 12 months was a reasonable probation sentence for obstructing police, Mr Hunter said.
The court heard Sam has a juvenile history of 17 court appearances and 53 charges.
