A tribunal panel heard the doctor's wife, known only as SLC, appeared to be scared of him and made domestic violence complaints against him on two occasions.

Despite this Tahir Shah inappropriately accessed her medical records more than a month after they had broken up and asked another doctor for details of his wife's liver cancer treatment.

SLC had left him "physically and emotionally" about August 12, 2012 and Dr Shah would have realised this soon after, the Queensland Civil and Administrative Tribunal found.

SLC, who had since passed away, made the first of two complaints to police on that day.

She claimed not to have heard from her husband until after September 13, when the Immigration Department told him his visa had been suspended because of the separation.

On September 25, Dr Shah turned up unexpectedly to her chemotherapy session at the Royal Brisbane and Women's Hospital with flowers, distressing her to the point nursing staff arranged for a social worker.

She made a second DV complaint to police later that afternoon.

The social worker "got the clear impression that SLC was frightened of Dr Shah", according to the Medical Board of Australia, which was pursuing the misconduct claim in QCAT.

The tribunal heard she had requested the transfer away from Nambour Hospital on the Sunshine Coast to the RBWH to get away from Dr Shah, who had previously involved himself in her care against her wishes.

In her affidavit, SLC described and "increasingly volatile and deteriorating marital relationship leading to a death threat and her decision to separate".

Two months before they separated, SLC complained about Dr Shah looking at her medical records without her permission, she swore, claiming he replied:

"Why not? You are mine, everything of yours is mine … I am your husband … I can check anything I want" and claimed the Privacy Act was in his opinion "Westernised … rubbish".

Dr Shah argued the board's case was founded on "incomplete, demonstrably unreliable hearsay", claiming he had maintained contact with his wife and she'd asked him to contact the other doctor to find out the latest information about her treatment.

He was concerned about her health and psychological well being and the bad influence that her Chinese Christian friends were having on her, the doctor argued.

But the decision by former Chief Justice Tim Carmody, published on Friday, found "as a witness of truth, Dr Shah did not impress".

"Overall he was unconvincing," he found.

"While his version was consistent and straightforward enough it is at odds with other evidence.

"The Tribunal accepts it did not withstand scrutiny or analysis."

The decision pointed to contradictions in written responses raising serious doubts about his "honesty, credibility and trustworthiness as well as his professional judgment".

The tribunal rejected Dr Shah's claim he was in "regular contact" with his wife until September 28.

"Whatever Dr Shah thought (or wants the Tribunal to believe he did) it is clear that from SLC's point of view that he was not someone who could ethically be involved in her treatment after mid-August 2012 or entitled to monitor or be informed of her progress," the judgment found.

"The Tribunal finds that Dr Shah abused his position of trust and confidence as a doctor and fell short of the standard of conduct that might reasonably be expected of him by the public or his professional peers.

"He breached his professional code of conduct by failing to maintain professional boundaries in respecting and protecting SLC's privacy and her right to confidentiality."

Dr Shah's medical registration was suspended for six months and he was ordered to go through a course on ethical decision making and patient confidentiality.
