Drew Ronald Major will be released on parole on August 24.
He was fined $1000 in the Mount Isa Magistrates Court on Monday after pleading guilty to charges of threatening violence, and obstructing police.
But Magistrate Stephen Guttridge ordered that Major serve time because of an existing two month suspended imprisonment order that the defendant failed.
Major had appeared in the court two more occasions since the order was made last October.
Police Prosecutor Senior Constable Paige Barrow said Major was obstructing police in a car park between two Fourth Avenue units.
Police were attempting to restrain Major’s 17-year-old sister Charlee Amelia Major at the time.
Charlee Major spat on police and was resisting arrest after she removed a confiscation notice off a car in front of the officers.
She said “I can do what the f—k I want” to police when they told her to put the confiscation notice back on the car, which belonged to her mother, Senior Constable Barrow said.
The magistrate ordered that Charlee Major serve a 12 month probation order. That meant reporting to a probation officer within 24 hours and obeying any reasonable directions the officer gave her.
No conviction was recorded against Charlee Major.
Solicitor Tim Carberry, from the Aboriginal and Torres Strait Islander Legal Service, said the siblings were visiting Mount Isa with their family to attend a football game.
Mr Carberry said that when Drew Major watched police restrain his sister he felt they were overreacting.
“He thought he was coming to her aid,” Mr Carberry said.
Mr Carberry noted his client had been in custody two days. However, the time in custody was not considered because Drew Major was being imprisoned for failing a suspended imprisonment order.
