The runners up in the Brownlow that year Sam Mitchell and Trent Cotchin have already been given the opportunity to present to league officials on the matter and that offer will be repeated for the November 15 AFL Commission meeting.

The AFL Commission will wait until November 15 to address the unresolved issues from the Essendon doping case - which can now be finalised after a Swiss Court upheld the Court of Arbitration for Sport guilty finding against the players. Watson is currently overseas and any other affected party must have sufficient time to draft their submissions.

The Commission will also consider wiping the games records for the 2015 season from the 34 past and present Essendon players who competed in that year. Wiping the records for players when they were technically serving a backdated ban would effectively mean Dustin Fletcher's would have ended his career on fewer than 400 games.

In March this year CAS banned the Essendon players for two years and backdated their period of ineligibility to the beginning of 2015. The ban meant the footballers played when ineligible and under WADA rules any results must be wiped.

The AFL commission will rule on the issue as the AFL executive's initial reaction has been the Essendon players had been punished enough and they would not alter the records.

The AFL has always maintained it was a matter for the Commission to decide whether Watson should be stripped of the game's fairest and best award that he won during a season in which Essendon players were found to have been given performance enhancing drugs.

Fairfax Media understands that Watson has made it clear to those close to him that he will not voluntarily hand the medal back.

Mitchell's manager, Peter Lenton, said the 5-time Hawthorn best and fairest winner felt uncomfortable at the prospect of being given the award in these circumstances and so declined the AFL's opportunity to make a presentation.

ASADA chief Ben McDevitt accused Essendon of asking for special treatment following the failure of their appeal to the Swiss Federal Tribunal.

The 34 past and present Bombers players were told on Tuesday night that their appeal had failed, with their legal representatives handed the judgment in German.

McDevitt, who has had confrontational and at times bitter relationship with those at Essendon and the AFL due to the saga, said on Wednesday that Essendon had tried to pick and choose when rules applied to them.

"You cannot agree to the rules and then expect them to change if you don't like the outcome," he said, referring to the nature of the appeal, which essentially argued that the Court of Arbitration for Sport should not have been allowed to start the case again, after the original finding from the AFL tribunal deemed it could not be "comfortably satisfied" that players were injected with performance-enhancing drugs.

Part of the official translation of the Swiss court's findings read: "The SFT determined that since the players did not formally challenge the jurisdiction of CAS during the arbitration procedure and accepted the application of the CAS Rules (including the rule providing for a de novo hearing (i.e. for a procedure allowing the CAS to conduct a full review of the case), they had lost their right to challenge the CAS jurisdiction in appeal."

McDevitt added: "Furthermore, CAS exists for the very reason of ensuring sports matters are heard fairly and independently, so it is essential that they be able to review all evidence and are not limited by the findings of sports tribunals.

"This ensures that anti-doping rules are applied consistently between cases, which is crucial in the global fight against doping."

While the saga is largely seen as now over, the players could technically take the matter to the European Court of Human Rights in France.

Legal representatives on Wednesday said that option hadn't even been considered yet and it is believed the prospect of a further appeal highly unlikely.
