Coreen Sharbon Corporal, 29, pleaded guilty in Mount Isa Magistrates Court on Wednesday April 7, to three offences including driving over the general alcohol limit but not over the middle limit, failing to drive with a supervised open licenced driver and failing to display L plates.
Police Prosecutor Nathaniel Gillis said on March 20 around 4.45pm, police were conducting patrols and intercepted a vehicle on Burke Street, Mount Isa.
"Police conducted a breath analysis of the defendant which returned a reading of 0.069. The defendant told police she had been sharing a box of wine with friends at a private residence," Mr Gillis said.
"When the defendant's checks were conducted it was discovered that she held a Queensland Learners Licence and was driving without an open licensed supervisor in the vehicle.
"Police also observed there were no L plates present on the vehicle."
Aboriginal and Torres Strait Islander Legal Service solicitor Kristin Martin represented Ms Corporal.
"This is an early plea of guilty and should be taken into account, she has a limited traffic history and nothing of a like nature," Ms Martin said.
"Fines may be within range and possible disqualification period of three months."
Magistrate Trinity McGarvie said she would take into account Ms Corporal's early plea, corporation, remorse and lack of history.
"I take into your account that it's very out of character as you have no like history. I will take into account your full admissions to police about all of your offending conduct, which was to incorporate with their investigation and evidence of your remorse," Magistrate McGarvie said.
"I have regard that you're a mature aged woman, you have the responsibility of a child within the community and your behaviour in driving on this occasion was poor.
"Based on your admissions you should never have anticipated that you could get behind the wheel of a vehicle, admitting to police you had been drinking, in your words, 'all day'."
Ms Corporal was disqualified for three months, fined $500, and recorded conviction.
